Tax Appeal and Tax Grievance Information for Residential and Commercial Property Owners
Dear Property Owner:
As you know, most municipalities across the country rely upon property taxes as their main source of revenue. Property taxes are needed to support basic governmental functions and programs. Property Taxes are generally “ad valorem” taxes, or taxes that are based upon property value. The actual tax amount YOU PAY is based upon
1) the assessment placed on the property,
2) the tax rate, and
3) an individual property owner’s eligibility for various exemptions.
Regarding item 3 above, you should know exemptions include Veteran’s exemptions, senior exemptions, and low income exemptions. Item 2, Tax Rates are set by legislative action and little can be done about tax rates with the exception of becoming politically involved in tax and budget matters and of course cut spending.
Item 1 above, property assessment, is where YOU, as the property owner posses the greatest opportunity to take actions that can lead to substantial reductions and savings in YOUR property taxes. Departments of assessment at all levels of local government (county, city, town, village) are charged with the task of determining the proper assessments based on their estimation of fair market value for the properties within their jurisdiction. Frankly put, it takes the average appraiser from 3-5 hours to appraise one single family home, and 2 to 3 weeks to appraise one commercial property. Do the math, it is physically impossible for a single assessor or two to accurately appraise all of the property under his or her jurisdiction. As such, the opportunity to uncover improperly assessed property and the Golden Opportunity to reduce your taxes and PAY ONLY YOUR FAIR SHARE.
Clearly, these are not the best of times with real estate values declining at historic rates in many areas. Lets face it, assessors are faced with an overwhelming workload. As described above, with the increase in grievances and appeals, downsized assessment departments, assessors simply don't have sufficient time to look at every property on a personal level Therefore, the chance that YOU ARE PAYING MORE THAN YOUR FAIR SHARE OF PROPERTY TAEXS is 92%. Of the 92% of property owners that overpay their property taxes, only 2% ever file a grievance, of the 2% over 96% win their tax appeal cases.
What can YOU DO to challenge and correct the assessors opinion of the Fair Market Value of your property not only for now but for years to come?
1: Have your property appraised by a Certified Real Estate Appraiser;
2: Contact your assessor for a copy of your assessment record;
3: Secure the latest documentation concerning the tax grievance and appeal process;
4: Review your assessment and compare it to the Certified Appraisal;
5: Schedule an informal meeting with the assessor to go over the appraisal and assessment;
6: Highlight the errors uncovered;
7: Be direct and ask the assessor to reconsider the value he or she placed on your property;
8: If denied, inquire of the "Grievance Day" and file a grievance;
9: If you own a commercial property, inquire as to the certiorari procedures;
10: You can do all of the above or allow us to appear as your expert witness.
The above information is provided to you so as to allow you to grieve your tax assessment on your own with some assistance from professionals, such as licensed or certified real estate appraisers, such as RICHARD GRECO APPRAISALS, Real Property Appraisers, Reviewers and Auditors.
